{"id":5834,"date":"2016-03-19T12:24:40","date_gmt":"2016-03-19T06:54:40","guid":{"rendered":"http:\/\/13.201.39.237\/?p=5834"},"modified":"2026-07-17T21:52:59","modified_gmt":"2026-07-17T16:22:59","slug":"amol-palekars-daayraa-trans-bill-2019","status":"publish","type":"post","link":"http:\/\/13.207.105.184\/?p=5834","title":{"rendered":"How to Treat the Trans Community: A Lesson for India from Amol Palekar\u2019s Daayraa"},"content":{"rendered":"\n<span class=\"dropcap\">I<\/span>n the opening scene of <\/span><a href=\"https:\/\/www.arre.co.in\/people\/amol-palekar-hindi-cinema-middle-class\/\"><span style=\"font-weight: 400;\">Amol Palekar<\/span><\/a><span style=\"font-weight: 400;\">\u2019s <\/span><i><span style=\"font-weight: 400;\">Daayraa <\/span><\/i><span style=\"font-weight: 400;\">(1996), Nirmal Pandey, who plays a transvestite in the film, is eavesdropping on a conversation between a theatre instructor and her student. \u201cToday, the public wants a woman playing leading roles,\u201d says the instructor. \u201cThe days of men playing women\u2019s roles are gone.\u201d This means that Pandey\u2019s character \u2013 who remains unnamed in the movie \u2013 will likely lose his livelihood.\n\nThe dejected face of Pandey, who is only beginning to process the loss, affords us a deeper reflection. The trans community, in film and in life, are marginalised \u2013 employment and other opportunities like education are severely limited for the community. <\/span><i><span style=\"font-weight: 400;\">Daayraa<\/span><\/i><span style=\"font-weight: 400;\"> never got a theatrical release in India, but it is just as relevant today as it was 23 years ago, especially when you view it in light of the <\/span><a href=\"https:\/\/www.arre.co.in\/gender\/transpeople-are-upset-with-the-transgender-persons-protection-of-rights-bill-2019\/\"><span style=\"font-weight: 400;\">Transgender Persons (Protection of Rights) Bill<\/span><\/a><span style=\"font-weight: 400;\">, 2019 which was now been made a law after it was passed in the Parliament and received Presidential assent.\n\nOn the face of it, the Transgender Persons (Protection of Rights) Bill, 2019 might appear to be empowering. It aims to prohibit discrimination against transgender persons in educational institutions, government offices, and while seeking healthcare and using public services. But the bill has led to tremendous unrest among the <\/span><a href=\"https:\/\/www.arre.co.in\/gender\/trans-acceptance-377-verdict-transgender\/\"><span style=\"font-weight: 400;\">trans community<\/span><\/a><span style=\"font-weight: 400;\">. One of the key objections is to the part that states that a transgender individual must apply to the District Magistrate for an identity certificate that acts as proof of recognition of his\/her\/their identity as a transgender person. Giving a medical officer the power to decide who deserves to identify as transgender \u2013 a strictly personal choice \u2013 is both regressive and downright inhumane.\n\nNot only are the implications of these developments worrying, but they also highlight the negligence of the Indian <\/span><a href=\"https:\/\/www.arre.co.in\/pov\/politics-career-liberals-youth\/\"><span style=\"font-weight: 400;\">political class<\/span><\/a><span style=\"font-weight: 400;\"> in policymaking. Things have changed adversely for the trans community over the centuries. From being a community that once held religious authority and were sought out for blessings, particularly during religious ceremonies, and held important administrative positions in 16th century Mughal courts, they have been reduced to society\u2019s discontents.\n\n<img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/13.201.39.237\/wp-content\/uploads\/2026\/07\/1576165311.jpg\" alt=\"Daayraa\" width=\"724\" height=\"407\" class=\"alignnone size-medium wp-image-57184\" \/>\n<figcaption>\n<p><em>Daayraa<\/em> is a sensitive exploration of sexual identity and gender stereotyping, with moving performances by both the leads of the film, Sonali Kulkarni and Nirmal Pandey.<\/p>\n<p>Gateway Entertainment\/ Saarth Productions<\/p>\n<\/figcaption>\n<\/figure>\n\nThe transgender law disempowers them, but Hindi films have done their bit in portraying them as mere caricatures, stigmatising them even further. In most Bollywood films, trans people are either demonised or are terrifying villains, as in <\/span><i><span style=\"font-weight: 400;\">Sangarsh<\/span><\/i><span style=\"font-weight: 400;\"> and <\/span><i><span style=\"font-weight: 400;\">Sadak<\/span><\/i><span style=\"font-weight: 400;\">. Or have the worst kind of comic stereotypes and <\/span><a href=\"https:\/\/www.arre.co.in\/gender\/trans-bill-same-sex-marriage-the-fight-is-far-from-over-for-mumbai-pride-parade-in-a-post-377-world\/\"><span style=\"font-weight: 400;\">transphobic<\/span><\/a><span style=\"font-weight: 400;\"> humour directed at them, \u00e0 la <\/span><i><span style=\"font-weight: 400;\">Kya Kool Hain Hum<\/span><\/i><span style=\"font-weight: 400;\"> and <\/span><i><span style=\"font-weight: 400;\">Masti. <\/span><\/i><span style=\"font-weight: 400;\">In both these cases, there is a sustained pattern of \u201cothering\u201d. Except <\/span><i><span style=\"font-weight: 400;\">Daayraa<\/span><\/i><span style=\"font-weight: 400;\">, which strays from convention to offer a deep insight about the struggles of being a trans person in a transphobic country. Based on a story by the award-winning novelist Timeri N Murari (who also wrote the screenplay), the film is a sensitive exploration of sexual identity and gender stereotyping, with moving performances by both the leads of the film, <\/span><a href=\"https:\/\/www.arre.co.in\/grub\/gulabjaam-marathi-cinema-food-2\/\"><span style=\"font-weight: 400;\">Sonali Kulkarni<\/span><\/a><span style=\"font-weight: 400;\"> and Nirmal Pandey.\n\nSet in a small village in Odisha, where men play women in street theatre, the story is centred around a transvestite \u2013 played by Pandey \u2013 struggling to make ends meet after his profession becomes obsolete. He comes across a young bride-to-be \u2013 Kulkarni, also unnamed \u2013 who had been kidnapped by a <\/span><a href=\"https:\/\/www.arre.co.in\/gender\/womens-day-tawaif-mumbai-brothels-prostitution\/\"><span style=\"font-weight: 400;\">brothel<\/span><\/a><span style=\"font-weight: 400;\"> madam, but manages to escape her. Things take a terrible turn when she is raped by another motorcycle gang. After this tragedy, Pandey\u2019s character takes her under his wing and persuades her to dress like a man so that they can pass off as a straight couple and make the journey back to her village in relative safety. But as soon as he is back in her village, she is spurned by her family and friends for being \u201cdamaged goods\u201d and driven out&#8230; only to be rescued by her transvestite friend.\n\nMurari\u2019s screenplay boasts of a richly resonant central conceit of a love story \u2013 both of them develop romantic feelings for each other \u2013 between the two protagonists. But it is the film\u2019s exploration of the tension between <\/span><a href=\"https:\/\/www.arre.co.in\/social-commentary\/what-its-like-to-be-a-transperson-house-hunting-in-cosmopolitan-mumbai\/\"><span style=\"font-weight: 400;\">sexual identity<\/span><\/a><span style=\"font-weight: 400;\"> and social circumstance in a bigotry traditional society, which offers little room for these conversations, that makes it stand out. This strange, sad road movie of sorts delicately probes complex issues of marriage, companionship, and romance, juxtaposing it with the journey of a transphobic character (Kulkarni) into one who openly accepts them.\n\n<blockquote class=\"quote--center\"><p><em>Daayraa<\/em> strays from convention to offer a deep insight about the struggles of being a trans person in a transphobic country.<\/p><\/blockquote> \n\nIn a remarkable scene in the movie, Pandey deconstructs our society\u2019s perceptions of <\/span><a href=\"https:\/\/www.arre.co.in\/satire\/womens-day-fragile-masculinity\/\"><span style=\"font-weight: 400;\">masculinity<\/span><\/a><span style=\"font-weight: 400;\"> and femininity. Kulkarni\u2019s character blames Nirmal Pandey for abandoning her, leading to her gangrape. To which Pandey replies that had he stayed, he\u2019d have been raped too. In a fit of rage, Sonali addresses him as a eunuch, neither a man nor woman. He replies, \u201cMust one have rippling muscles to be a man? Or a moustache and a beard? Do naked breasts make a real woman? Or tearful helplessness? A man must be vigorous, a woman a shrinking blossom. I\u2019m a miracle of nature. Within I\u2019m a part man, part woman. It pleases me to reveal the woman within me. It matters little to me whether others accept me or not.\u201d\n\nThe Transgender Persons Bill, however, sees no \u201cmiracle of nature\u201d among trans people. Rather, it <\/span><a href=\"https:\/\/www.thenewsminute.com\/article\/despite-massive-protests-trans-bill-gets-president-s-assent-becomes-law-113643\"><span style=\"font-weight: 400;\">forces<\/span><\/a><span style=\"font-weight: 400;\"> them to undergo gender affirmation surgery and get their gender \u201ccertified\u201d by the District Magistrate. The sex reassignment surgery in question, has many side effects, it is a complicated and a life altering surgery. The question is, why should as crucial a decision, not be left to the person?\n\nIn yet another powerful scene, Kulkarni\u2019s character, points out that a mere change of clothes does not change the wearer \u2013 despite the guise, we stay as God made us, some men, some <\/span><a href=\"https:\/\/www.arre.co.in\/gender\/why-are-indian-women-so-shy-of-baring-their-bodies-in-front-of-each-other\/\"><span style=\"font-weight: 400;\">women<\/span><\/a><span style=\"font-weight: 400;\">. To which, Pandey replies, \u201cSometimes I wonder, God who made this world, so complex, so colourful, how would he have been satisfied with merely creating man and woman? How could he have resisted from making human beings more complex?\u201d This empathy, this humanising of a community is exactly what\u2019s missing from the trans bill.\n\nBut perhaps <\/span><i><span style=\"font-weight: 400;\">Daayraa<\/span><\/i><span style=\"font-weight: 400;\">\u2019s biggest victory lies in the representation of the trans community alone. Think about <\/span><a href=\"https:\/\/www.arre.co.in\/pop-culture\/blade-black-panther-marvel-superheroes\/\"><i><span style=\"font-weight: 400;\">Black Panther<\/span><\/i><\/a><span style=\"font-weight: 400;\">, which gave us our first black superhero almost two years ago \u2013 it has been hailed as a model success story for depicting diversity on screen. A <\/span><a href=\"http:\/\/racialequitytools.org\/resourcefiles\/Media-Impact-onLives-of-Black-Men-and-Boys-OppAgenda.pdf\"><span style=\"font-weight: 400;\">2011 study<\/span><\/a><span style=\"font-weight: 400;\"> conducted by The Opportunity Agenda found that black males in media are usually portrayed negatively, limited to a handful of \u201cpositive\u201d stereotypes, painted as flat characters, or missing altogether. Audiences \u2014 especially those with little exposure to those outside of their community \u2014 typically equate these limited, and harsh, media representations with the real world.
